The case of Mengo v. Mbenenge has been postponed and is scheduled to resume from May 5 to May 16, 2025. Judge President Selby Mbenenge of the Eastern Cape High Court faces allegations of sexual harassment and misconduct.

The complainant, Andiswa Mengo, a High Court secretary, alleges that Judge President Selby Mbenenge sent her explicit images and harassed her over several months.

Mbenenge’s lawyer, Adv. Muzi Sikhakhane,informed the judicial conduct tribunal investigating the sexual misconduct allegations that Mbenenge would deny ever sending the explicit photos, and that no experts were able to find them on either his phone or the phone of the complainant.

When cross-examined by Sikhakhane, Mengo, admitted to omitting certain facts in her affidavit of complaint to the Judicial Service Commissions (JSC), such as the fact that she entertained the messages from Mbenenge and had her own sexual remarks towards the defendant.

In today’s, cross-examination, Sikhakhane talked about the contradiction statements Mengo made telling the tribunal that in her recent statement she makes mention of a new date of events different from the one in her first statement.

Mengo was visibly emotional as she told the tribunal about the incident which led her to formally lodge a complaint. She said that Mbenenge called her into her chambers at the Eastern Cape High Court in Mthatha on the 14th of November 2022 where he pointed at his crouch asking her if she saw the effect she had on him and proceeded to unzip his pants and asked if she “did not want to suck it.”

After dissecting a plethora of sexually suggestive messages between the complainant and the defendant since the 13th of January 2025, the tribunal has adjourned the case for further investigation.
