It is day four of the Judicial Conduct Tribunal Hearing, where Eastern Cape High Court Judge, President Mbenenge faces allegations of sexual misconduct.
The complainant, High Court Secretary, Andiswa Mengo alleges that Mbenenge shared inappropriate messages with her from June 2021 to November 2022, including an image of his genitals.
In today’s proceeding, Chair, Advocate Scheepers reviewed WhatsApp messages between Mbenenge and Mengo from June 2021. The messages read Mbenenge sending inappropriate emojis to Mengo, trying to get Mengo’s location, and asking to meet up with her outside of work.
While giving context to the conversations between Mbenenge and herself, Mengo expresses that at the time, she felt annoyed, angered, and embarrassed by these messages, considering that Mbenenge was her boss, and she viewed him as a respectable man.
Mengo further explains that even when she ignored him or tried to end the conversations, Mbenenge continued to text her. She also admits that at times, she would also go along with these inappropriate conversations to try and put an end to them.
During the hearing, Scheepers would ask Mengo to clearly explain some of her responses to Mbenenge’s advances as they seemed to enable his behaviour, whereas Mengo assured Scheepers that that was not the case. Mengo says that with every interaction, she had to always remember that Mbenenge was her boss and that he had authority, which would then influence some of her responses.
Day five commences tomorrow, where Mengo continues her testimony as newer conversations are reviewed, and more evidence unfolding.
